2. Activity, responsible person and producer
FETĒN sells cosmetic products under its own brand in accordance with Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products.
Somos Fetén, S.L. is the responsible person for the cosmetic product within the meaning of Article 4 of Regulation (EC) No 1223/2009, and the producer for the purposes of the European Union rules on liability for defective products, because the products are placed on the market under its own name and trade mark. The products are manufactured to order by a third-party laboratory.
Because FETĒN is established in Spain and the products are made available on the European Union market under its own brand, a single responsible person covers all Member States and a single notification to the Cosmetic Products Notification Portal (CPNP) under Article 13 of that Regulation is valid throughout the European Union. No separate designation is required in any individual country.
The competent authority for cosmetic products at FETĒN's place of establishment is the Spanish Agency for Medicines and Medical Devices (AEMPS). You may also contact the competent cosmetics authority of your own country.
3. Purpose of this Legal Notice
This Legal Notice governs access to and use of the website somosfeten.com. It does not govern purchases: purchases are governed by the General Terms and Conditions of Sale, which are accepted expressly and separately during checkout.
Accessing the website means that you are aware of this Legal Notice, the Privacy Policy and the Cookie Policy. It does not mean that you accept the General Terms and Conditions of Sale, which are accepted only when you confirm an order by ticking the relevant box at checkout.
You can consult the General Terms and Conditions of Sale, the Privacy Policy, the Cookie Policy, the Withdrawal and Returns Policy and the Shipping Policy at any time from the footer of this website.
4. Language
This website, the pre-contractual information and the contract are provided in English. Customer service is provided in English and in Spanish.
5. Conditions of use of the website
You undertake to use the website in accordance with the law, with this Legal Notice, and with public order. In particular, you undertake not to use it to:
- distribute content that harms human dignity, that discriminates on grounds of race, sex, opinion, religion, nationality, disability or any other personal or social circumstance, or that harms the protection of children and young people;
- introduce or spread viruses or any code capable of damaging the systems of FETĒN or of third parties;
- attempt to access restricted areas, interfere with the operation of the website, or carry out unauthorised mass data extraction;
- impersonate another person or provide false information.
If you breach these conditions, FETĒN may suspend your access to the website by a measure proportionate to the breach, telling you the reason in writing. That measure does not affect orders you have already placed, and you may ask us to review it by writing to hola@somosfeten.com.
6. Availability and changes to the website
FETĒN aims to keep the website continuously available, but cannot guarantee the complete absence of interruptions caused by maintenance, technical incidents or circumstances beyond its control.
FETĒN may modify, extend, suspend or withdraw content, services and features of the website for technical, organisational, security or legal reasons, giving as much notice as the circumstances reasonably allow. Those changes will not affect orders you have already placed, which are governed by the terms in force when they were confirmed.
7. Intellectual and industrial property
All content on the website — text, photographs, illustrations, videos, graphic design, source code, trade marks, trade names, logos and distinctive signs — is owned by Somos Fetén, S.L. or by third parties who have authorised its use, and is protected by European Union and national intellectual and industrial property law.
Reproduction, distribution, communication to the public, adaptation or any other form of exploitation is prohibited without the express written authorisation of FETĒN, except for uses permitted by law.
The FETĒN trade mark and the other distinctive signs appearing on the website belong to FETĒN. Accessing the website grants you no right over them.
8. Links to third-party sites
The website may contain links to third-party sites, such as social networks or payment providers. FETĒN does not control and accepts no responsibility for their content or their privacy policies, which are governed by their own terms. The existence of a link does not imply any relationship, recommendation or supervision.
9. Liability
FETĒN is liable for damage it causes in connection with the use of this website in accordance with applicable law.
FETĒN does not exclude or limit in any way its liability for wilful misconduct, gross negligence, death or personal injury, or any other liability that the law does not allow to be excluded or limited as against consumers. In particular, it does not exclude or limit liability for defective products.
Outside those cases, and to the extent permitted by law, FETĒN is not liable for damage arising from: technical interruptions or errors beyond its control; improper use of the website by the user; the content of linked third-party sites; or the presence of viruses or other harmful elements introduced by third parties despite the security measures in place.

FETĒN is not committed to, and does not participate in, any alternative dispute resolution (ADR) entity. If we are unable to resolve a specific complaint directly with you, we will tell you on paper or on another durable medium which ADR entity or entities are competent to deal with it and that we do not intend to use them.
As a consumer, you may in any event contact the competent consumer protection authority or ADR entity in your own country of residence. If you are resident in a Member State other than Spain, you may also contact the European Consumer Centre (ECC-Net) in your country, which provides free assistance in cross-border purchases within the European Union.
The processing of your personal data is governed by our Privacy Policy, and you may lodge a complaint with a data protection supervisory authority as explained there.
12. Governing law and courts
This Legal Notice is governed by Spanish law. This choice does not deprive you of the protection of the mandatory consumer protection rules of your country of habitual residence, which continue to apply, in accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I).
If you are a consumer, under Articles 17 to 19 of Regulation (EU) No 1215/2012 (Brussels I bis) you may bring proceedings before the courts of your country of residence or before the Spanish courts, at your choice, and we may bring proceedings against you only before the courts of your country of residence. You do not waive any forum that the law grants you.
