Cookie Policy

1. What cookies and equivalent technologies are

A cookie is a small text file that a website stores on your device (computer, phone or tablet) when you visit it, and which allows information about your browsing to be retrieved. Alongside cookies there are other technologies with the same function — pixels, web beacons, browser local storage and analytics scripts — which are subject to the same legal regime and which we also refer to as "cookies" in this policy.

Depending on who manages them, they may be first-party (managed by FETĒN) or third-party (managed by another entity). Depending on their lifetime, they may be session cookies (deleted when you close the browser) or persistent cookies (kept for a set period).

2. Applicable legal framework

The use of cookies is governed by Article 5(3) of Directive 2002/58/EC (the ePrivacy Directive), as transposed into the law of each Member State, which requires your consent after you have been given clear and comprehensive information about their use, in particular about the purposes of the processing.

That same provision exempts from consent technical storage or access carried out for the sole purpose of transmitting a communication, or strictly necessary in order to provide a service you have expressly requested. The cookies described in clause 4.A are the only ones covered by that exemption.

Where cookies involve the processing of personal data, Regulation (EU) 2016/679 (GDPR) also applies. Information about that processing is in our Privacy Policy.

3. How we obtain and manage your consent

When you first visit somosfeten.com we show you a cookie notice with two options:

  • "Accept" — you consent to the use of all the cookies described in this policy, including analytics and advertising cookies.
  • "Essential only" — you do not consent to analytics or advertising cookies. Only the strictly necessary technical cookies described in clause 4.A will be used.

This is exactly how our cookie notice works today:

  • Your choice is stored in a first-party cookie called feten_consent, which takes the value accepted or rejected, has a lifetime of 365 days and is set with the SameSite=Lax attribute.
  • The two options are not presented with the same visual prominence: the "Accept" button is more prominent than the "Essential only" button.
  • We do not offer a settings panel by category: the choice is between the two options above.
  • There is no permanent link in the site footer for changing your choice: to choose again you must delete the feten_consent cookie, as explained below.
  • The Microsoft Clarity analytics service loads when the page opens, before you are able to express your choice, as described in clause 4.B.

How to change your mind or withdraw your consent. You can do so in two ways, at any time and free of charge:

  1. By writing to hola@somosfeten.com. Tell us that you want to withdraw your consent for cookies. We will explain how to delete the feten_consent cookie from your device so that the notice asks you again, and we will confirm in writing what we have done within one month of your request.
  2. By clearing the cookies in your browser. Deleting the feten_consent cookie means we will ask you again next time you visit. You can also block or delete cookies from your browser settings:

Refusing analytics and advertising cookies does not prevent you from browsing the site or making a purchase. We do not use cookie walls.

An important warning about the scope of a refusal: because the Microsoft Clarity script loads when the page opens, refusing cookies does not prevent the visit during which you refused from having been recorded by that service. The effective way to prevent it is to block the domain clarity.ms, as explained in clause 4.B.

4. Which cookies we use

Below we describe the categories of cookies we use and the providers involved in each. The specific names and exact lifetimes of third-party cookies are set by each provider and may change; you can check them in your browser settings and in each provider's documentation.

4.A Technical or necessary cookies — exempt from consent

These are essential for the site to work and for you to be able to buy. Without them the basket cannot be kept and payment cannot be completed.

  • First-party cookie feten_consent (Somos Fetén, S.L.): stores your choice about cookies (accepted or rejected). Lifetime: 365 days.
  • Technical cookies of Shopify International Limited, the e-commerce platform provider: browsing session identification, maintaining the basket and the selected currency, authenticated customer session, checkout security, recording the tracking choice, and country and language detection.

4.B Analytics and behaviour measurement cookies — consent required

These help us understand how the shop is used so that we can improve it. Two providers are involved:

  • Google Ireland Limited — Google Analytics 4: distinguishing users and maintaining session state for statistical purposes. Involves an international transfer to the United States.
  • Microsoft Ireland Operations Limited — Microsoft Clarity: identifying the visitor and grouping together the pages viewed in a single session. Involves an international transfer to the United States.

Specific statement about Microsoft Clarity

What it does exactly: Clarity records your interaction with the site and your browsing, including cursor movements, page scrolling, clicks and time spent, and uses that information to reconstruct a recording of your session and to build aggregated heatmaps of the most and least used areas of each page.

Purpose: analysing use of the website, detecting errors and improving the shopping experience.

How it loads today: the Clarity script loads when the page opens, before you are able to express your choice in the cookie notice. We do not currently apply enhanced masking of the content of form fields.

International transfer: yes, to the United States. See clause 5 of this policy and clause 7 of the Privacy Policy.

How to prevent it: the effective way to prevent the recording is to block the domain clarity.ms in your browser or with a blocking extension. In addition, if you write to hola@somosfeten.com telling us the approximate date of your visit, we will request the deletion of the data associated with your browsing and confirm the outcome to you.

4.C Advertising and marketing cookies — consent required

These let us measure the effectiveness of our advertising and adjust the ads and communications you receive. Two providers are involved:

  • Meta Platforms Ireland Limited: browser identification for advertising, conversion measurement, ad relevance and recording of ad clicks. Involves an international transfer to the United States.
  • Klaviyo, Inc.: visitor identification and linking of browsing to the marketing profile. Involves an international transfer to the United States.

5. Third parties and international transfers

Third-party cookies are managed by the entities identified in clause 4, which act in accordance with their own privacy policies, available on their respective websites. The processing carried out by Google, Microsoft, Meta and Klaviyo involves international transfers of data to the United States, made under the mechanisms provided for in Chapter V GDPR. You can ask us which safeguard applies to each provider by writing to hola@somosfeten.com.

6. How long your consent lasts

Your choice is stored in the feten_consent cookie for 365 days. After that period we will ask you again.

The cookie guidance of the Spanish Data Protection Agency, which is the supervisory authority of the country where FETĒN is established, states that consent given by a user should not last longer than 24 months; our period of 365 days is shorter than that reference. The supervisory authority of your own country may apply a shorter reference period, and where it does we will follow whichever is shorter.

7. Your rights

The processing of personal data associated with cookies gives you the rights of access, rectification, erasure, restriction, portability and objection, as well as the right to withdraw your consent at any time, on the terms described in the Privacy Policy. You can exercise them at hola@somosfeten.com, and you may lodge a complaint with the data protection supervisory authority of your own country or with the Spanish Data Protection Agency (Paseo de la Castellana, 141, 28046 Madrid, Spain — https://www.aepd.es).

8. Updates to this policy

We review this policy whenever the cookies we use or the providers we work with change. The version in force is always the one published on this page, with its last updated date.
